Terms of Service

SantaPass lets an organiser (“owner”) connect a Telegram bot and run one or more Secret Santa draws inside it. Participants (“players”) join a game, submit a wishlist, receive a match after the draw and exchange anonymous messages with their Santa. The service consists of (a) the bot runtime, (b) the web cabinet for owners and (c) the Telegram Mini App for players.

Sign-in is delegated to Telegram (or, for tenant subdomains, Google). You are responsible for keeping your Telegram account secure and for any activity performed through your account. You must be at least 13 years old (16 in the EU) to use the service.

If you connect a bot, you act as the controller of your players’ data. You agree to:

• use the bot only for legitimate Secret Santa activity — no spam, no mass broadcasting outside your team;
• obtain any consent required in your jurisdiction from players before inviting them;
• keep the bot token confidential; if it leaks, rotate it in @BotFather and reconnect;
• handle refund/dispute conversations with your own team — SantaPass is not a party to internal gift exchanges.

A paid subscription (“season”) unlocks the bot until 15 February of the following year, regardless of when you purchase it. Payments are processed by Telegram in Telegram Stars. We do not store card details. Prices and tier limits are shown on the pricing page and at checkout; the active tier caps the total number of players across all games in the bot.

Subscriptions do not auto-renew. When the season ends the bot stops accepting new games until you buy another season.

If the bot has never completed a draw, you may request a full refund within 14 days of payment by DMing @SantaBillingBot. Once any draw has been executed the season is considered consumed and is non-refundable. Partial-season refunds are at our discretion.

You agree not to:

• upload, send or request unlawful, harassing, hateful or sexually explicit content;
• attempt to deanonymise a draw, reverse-engineer the matching algorithm or scrape the platform;
• use the service to send unsolicited commercial messages;
• interfere with the infrastructure, the bot runtime or other tenants;
• bypass tier limits or payment obligations.

We may suspend or terminate bots that violate these rules without refund.

Wishlists, game names, welcome texts and chat messages remain your (or your players’) property. By submitting content to the service you grant SantaPass a limited, non-exclusive licence to host, process and display that content to the intended recipients inside the same game, for the sole purpose of operating the service.

SantaPass — the source code, the brand, the bot scripts, the Mini App and the documentation — belongs to the operator. Using the service does not transfer any intellectual property rights to you. You may not copy, resell or sublicense the platform.

You can disconnect your bot at any time from the cabinet. We can suspend or terminate your access immediately if we reasonably suspect a breach of these Terms, a payment dispute, or a risk to the platform or other tenants. On termination we retain data as described in the Privacy Policy.

The service is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, error-free, or free of Telegram-side or Google-side outages. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, the operator’s total aggregate liability arising out of or relating to the service is limited to the amount you actually paid to SantaPass in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost data or reputational harm.

We may update these Terms. Material changes are announced in the cabinet at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.

These Terms are governed by the laws of the operator’s jurisdiction of incorporation, excluding conflict-of-law rules. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of that jurisdiction, unless mandatory consumer-protection law provides otherwise.
